Whatcha, Inc (“Whatcha,” "Podmob" “we,” “us,” or “our”) respects the privacy of individuals who use our website, mobile application, and related services (collectively, the “Services” or “Whatcha Services”).  This privacy policy (the “Privacy Policy”) applies to all Whatcha Services, regardless of the platform or device used. This Privacy Policy describes how information about you is collected, used, and shared by us via the Whatcha Services and is intended to further help you understand and exercise your privacy rights.

Please read this Privacy Policy carefully to fully understand how we collect, use, share and protect your personal information.  By using the Podmob Services, you are consenting to the practices described in this Privacy Policy.  If you do not agree with this Privacy Policy, please do not use our Services.  Beyond the Privacy Policy, your use of our Services is also subject to our Terms of Use and Service.    

1.     Information You Provide to Us Directly.

When you use our Services, we may collect and store personal information you provide, including:

  • Account Creation and Profile Information. If you sign up for an account, register to use our Services, or sign up for notifications or updates, we receive personal identifiers you provide (including, for example, information such as your name, email address, username and password) and use this information to respond and complete your requests (including providing notifications related to your lists, communication with you for registration, customer service and information purposes (including, sending you confirmation emails, notices and updates, and communications with you for marketing purposes).
  • User Content. The Services allow you to post User Content (as defined in the Terms of Use and Service). Any User Content you post may become available to the public via the Services.  User Content includes, but is not limited to, reviews, ratings, lists, likes, content contributions and visual information.  If you remove User Content, copies may remain viewable on our Services in cached and archived pages or if other users have copied or stored your User Content. 
  • Interactive Features. We and others who use our Services may collect personal information that you submit or make available through our interactive features (e.g., sharing features, editing functionalities, content contributions, recommendations, reviews, likes, ratings, lists and social media pages). Any information you provide on the public sections of these features will be considered “public”, unless otherwise required by applicable law, and is not subject to the privacy protections referenced herein.
  • Podmob Referral Information. If you use our share functionality to recommend podcasts to tell a third party about Podmob or to send podcasts to a third party, you may need to provide contact information for yourself and the third party. We may send such third party, an email or text inviting such third party to visit our Services. Podmob may store this information for the purpose of sending this referral link and tracking the success of our referral program.
  • Email. By providing Podmob your e-mail address, you consent to us sending you Service-related notices, including any notices required by law, in lieu of communication by postal mail. We may also use your e-mail address to send you other messages, such as newsletters, changes to features, notices of member-initiated content, or special offers. You may opt-out of non-Service related emails by contacting us at sup@podmob.com.
  • Commercial Information. We may collect and generate commercial and transaction information (such as records of products and services used on our website, application or Services which you have enrolled in).  We use this information to respond to and fulfill requests, improve our product and service offerings, communicate with you, tailor our marketing offers, and for internal reporting purposes. 
  • Inferences from the Information Listed Above. We may use the information listed above to draw inferences about your preferences to help us develop and provide better products and services. 

2.    Information Collected Automatically from Your Use of Our Services.

We may automatically collect information about you when you use or interact with our Services. The information we collect and analyze from your use or interaction with our Services includes:

  • Device metrics such as the device and software you use to access our Services, including, IP addresses, web browser type, operating system version, mobile carrier and manufacturer, application installations, unique device identifies, location information, mobile advertising identifiers and mobile network information such as phone number and push notification tokens.
  • Login, e-mail address, contact information, username and password.
  • Podmob Services metrics (e.g., the occurrences of technical errors, your interactions with service features and content, like the lists, liking and ratings, the searches you conduct, people you follow, people who follow you, your lists, shared lists, shared content, content contributions, responses, registrations, interfacing with social networking sites and any other content you post and the dates, times, frequency and duration of your visits and interactions, your settings preferences, location of your device running an application).
  • The full Uniform Resource Locator (“URL”) clickstream to, through, and from our websites, including date and time of your visits, content you viewed or searched for; how long you spent on the Podmob Services.
  • User-specific and aggregate information regarding thelength of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), page response times, and download errors.
  • Many mobile devices permit applications to access real real-time geolocation information.  With your consent, we may collect and use such information when you use our Services.  In addition to mobile device settings, we may use various technologies to determine and infer location, including IP addresses, GPS, and other sensors that may, for example, provide us with information on nearby devices, Wi-Fi access points and cell towers and provide geo-location information. 
  • We may collect information that other people provide about you when they use our Services, including information about you when they add you to a list or refer you to a list or to use our Services.

3.    Cookies and Other Identifiers.

We, as well as third parties that provide content, advertising, or other functionality on our Services, may use cookies, mobile identifiers web beacons, local storage, and other technologies (the “Technology”) to automatically collect information through your use of our Services.

  • Cookies. A cookie is a small file containing a string of characters that is sent to your computer when you visit a website.  When you visit the website again, the cookie allows that site to recognize your browsers.  Cookies may store user preferences and other information.  You can reset your browsers to refuse all cookies or to indicate when a cookie is being sent.  However, some of our Services may not function properly without cookies. 
  • Mobile Identifiers.  We may use application program interfaces (“APIs”) and software development kits (“SDKs”) that make or use mobile advertising identifiers (i.e., IDFA on Apple mobile devices or Advertising ID on Android mobile devices), which function similarly to cookies on mobile devices.  You may reset your IDFA or Advertising ID in the settings on your mobile device. 
  • Web Beacons. Small graphic images or other web programming codes called web beacons (also known as “1x1 GIFs,” “one-pixel GIFs,” “pixel tags” or “clear GIFS”) may be included in our Services.  Web beacons may be invisible to you, but any electronic image or other web programming code inserted into a web page or e-mail can act as a web beacon. Web beacons or similar technologies may be used for several purposes, including, without limitation, to count visitors to the Podmob Services, to monitor how users navigate the Podmob Services, to make cookies more effective, and to analyze how our emails, articles and links are opened, viewed and used.

We may use the Technology to recognize your browser or device, learn more about your interests, and provide you with essential features and services and for additional purposes, including:

  • Functionality. Recognizing you when you sign-in to our services and keeping track of your specified preferences, interests, or past items viewed.
  • Performance. Accessing the performance of our Services, including understanding how individuals use our Services.
  • Operational. Identifying irregular website behavior, preventing fraudulent activity and improving security.
  • Analytical. Allowing us to measure and analyze the performance of our Services which may include third-party tools to process the analytical information on our Services.
  • Target Related and Advertising. Delivering content, including ads that are relevant to your interests on our Services or third-party websites. Third parties include providers of measurement and analytics services, social media networks, and advertising companies. Third parties may use cookies in the process of delivering content, including ads relevant to your interests, to measure the effectiveness of their ads, and to perform services on behalf of Podmob.

4.    Information Third Parties Provide About You.

We may, from time to time, obtain information about you from third parties in order to enhance our ability to serve you, to tailor our content to you, to offer you opportunities to purchase products and services that we believe may be of interest to you, and to improve our products and services.  These third-party sources include:

  • Social Networks and Publicly Available Data. Our Services includes social media features and widgets, such as the “Share” button or similar functions.  These features may collect your IP address, the pages you are visiting on our Services, and may set cookies to enable them to function as you have requested. Social Media features and widgets are either hosted by a third party or directly on our Services.  
  • Information that is Collected from Marketing Partners and Data Providers. We may collect additional information about you such as demographic data, personal identifies, commercial information and generally available information from third parties such as marketing partners or data providers and combine it with other information we have about you.
  • Information Other Users Provide About You. Other users may provide us your personal identifiers (such as your email address and telephone number) or other information in order to invite you to use the Podmob Services or share content from the Podmob Services with you.  In this case, we will use the information for the purposes for which it was provided. 
  • Other Information with Your Consent. We also may collect other information about you, your device, or your use of the services in ways that we describe to you at the point of collection or otherwise with your consent.  You may choose not to provide us with certain types of information but doing so may affect your ability to use some of the Podmob Services. 

5.     How We Use Your Information.

We use your information we collect:

  • To provide, maintain, improve and enhance our Services. 
  • To personalize your experience on our Services such as providing tailored content and recommendations or connecting you to other users. 
  • To understand and analyze how you use our Services and develop new products, services, features and functionality.
  • To communicate with you, provide you with updates and other information related to our Services, provide information that you request, create, respond to reviews.
  • To send messages on your behalf to your social networks, and to provide other features and services to you.
  • To facilitate the connection of third-party services or applications, such as social networks and streaming services. 
  • For marketing and advertising purposes, such as developing and providing promotional and advertising materials that may be relevant, valuable or otherwise of interest to you.
  • To generate anonymized, aggregate data containing de-identified, non-personal information that we may use to publish reports. 
  • To send you text messages and push notifications.
  • To find and prevent fraud.
  • To respond to trust and safety issues that may arise.
  • For compliance purposes, including enforcing our Terms of Use and Service or other legal right, or as may be required by applicable laws and regulations or requested by any judicial process or governmental agency.
  • For other purposes for which we provide specific notice at the time the information is collected. 

6.    How We Disclose Your Information

We may disclose your information to third parties for a variety of purposes, including to provide our Services, to protect us or others, or in the event of major business transfers such as a merger, sale, or asset transfer, including:

  • Service Providers. We may share your personal information with third party service providers who use that information in connection with the provisions of our Services (including, but not limited to, service providers that help us maintain our databases and websites, administer emails, display content, analyze website usage activity and provide us with hosting, and related services). 
  • Analytics Partners.  We may use analytics services to collect and process certain analytics data to help us understand how you use our Services and to help us improve them, like the pages you visit or other content you view, the searches you conduct, people you follow, purchases you make, your comments, any content you post, and the dates and times of your visits. 
  • Commercial and Business Partners.  We may share your personal information with commercial and business partners to provide you with products and services you have requested. We may also share your personal information with commercial and business partners with whom we jointly offer products or services. 
  • Advertising Partners. We may work with third party advertising partners to show you ads that we think may interest you. We may share your personal information and commercial information with advertising partners that use various cookies or Technology to send (or serve) relevant ads to you on your device. We may also use email services to send informational and marketing emails, and analytics services to help us understand and improve the usage of Services and emails. These services may collect your personal identifiers (such as IP address, device ID, pages visited, location, time of day and cookie information), device characteristic (such as browser version), and website browsing activity by placing cookies and using other similar technology.  These advertising partners may use that information to provide advertisements to you on partner, affiliate and non-affiliated websites or applications and/or to provide analytical information to us.  These companies may collect and combine information about your online activities over time, on other devices, and on other websites, applications or online services that we do not control, if those websites, applications and online services also use the same partners. To learn about your options to opt-out of personalized advertising, please review the Privacy Rights and Opt-Out Choices section below. 
  • Social Networks. Certain features of the Podmob Services allow you to, on your direction, share certain categories of personal information to be published to your social networks. You understand and agree that the use of your personal information by any social networking website will be governed by the privacy policies of these third-party platforms and your settings on that platform. We encourage you to review the privacy policies of these social networks. 
  • Public Disclosures Using Non-Restricted Services. As explained by the Terms of Use and Service, information provided by you in the content of your lists, likes, ratings, content contributions (e.g., podcast descriptions, genres or steaming services) and other communications on our Services (“Posts”) may not be private or confidential. Posts may be collected, copied, or used by others without your or our knowledge, and the security and other protective provisions of this Privacy Policy will not apply. Please exercise caution and good judgment when disclosing any personal information, including in Posts on the Podmob Services. Note, that we cannot and will not be responsible for any online postings by a family member, friend, acquaintance or other person or entity outside of our control. 
  • Business Transfers.  In the event of a merger, acquisition, financing, reorganization, bankruptcy, receivership, sale of company assets (whether by private sale, through operation of law, as part of a divestiture plan, or otherwise) your personal information, and any other information that we have collected, may be disclosed to the persons and/or entities assuming control of the relevant business unit or as otherwise necessary to complete the transaction as permitted by law or contract. 
  • Legal and Similar Disclosures. We may disclose personal information about you with law enforcement, the courts, our advisors, attorneys, and others who participate in the legal process, if necessary to do so by law or based on our good faith believe that it is necessary to enforce or apply our contracts, conform or comply with the law or is necessary to protect us, the users of the websites, or others. 
  • Otherwise with Your Consent or at your Direction. In addition to the sharing described in this Privacy Policy, we may share information about you with third parties whenever you consent to or direct such sharing. 

7.    Privacy Rights and Opt-Out Choices

We offer you choices regarding the collection, use and sharing of your information on the Podmob Services. 

Upon request, Podmob will provide you with information about whether we hold any of your personal information. You may also exercise your preferences in the following manner:

  • Email Communications. When you receive promotional communications from us, you may indicate a preference to stop receiving further communications from us, and you may “opt-out” by contacting us directly at sup@podmob.com. Regardless of your indicated email preferences, we may send you administrative emails regarding the Podmob Services, including, but not limited to, for example, notices of updates to our Terms of Use and Service or this Privacy Policy, registration and user related communications (as appropriate), Posts you make, and other information related to your account.
  • Mobile Devices. With your consent, we may send you push notifications through our mobile application. You may opt-out from receiving these push notifications by changing the settings on your mobile device. With your consent, we may also collect precise location-based information if you use our mobile application. You may opt-out of this collection by changing the settings on your mobile device.
  • Update or Delete Account Information. If you wish to verify, correct, update or delete any of the personal information provided to us in connection with your account on the Podmob Services, you may do so by emailing us at sup@podmob.com. Please note that we may be required (by applicable law or otherwise) to keep certain information and not delete it, in which case we will comply with your deletion request only after we have fulfilled such requirements. It may not always be possible to completely remove or delete all your information from our databases without some residual data remaining in our archives because of backups or other reasons. If you would like to make a request related to then personal information we have about you, you may contact us at sup@podmob.com. 
    • If you wish to update or delete a Post, you may contact us using the “How to Contact Us” information below. In some cases, we may not be able to remove your personal information, in which case we will let you know and explain why. 
  • Do Not Track. There is no accepted standard on how to respond to “Do Not Track” signals, and Podmob does not respond to or honor such signals.
  • Personalized Advertising. If you do not wish for our third-party partners to provide you with personalized advertising based on your cookies or Technology activities and interests, you may opt-out of receiving such advertisements on our Services by contacting us at sup@podmob.com. Please note that even if you choose to remove your information or “opt-out” you may continue to see advertisements while you are browsing online; however, those advertisements will no longer be tailored to your interests. Additionally, information regarding your usage may still be collected for research, analysts or internal operations purposes.
    • Please note that cookie-based opt-outs may not be effective on mobile applications. However, you can access any settings offered by your mobile operating system to limit ad tracking, or you can install the App Choices mobile app to learn more about how you may opt out of personalized ads in mobile apps. 
  • You may also opt-out of some network advertising programs that use your information, below are other steps you can take to opt-out.
    • Visit the Digital Advertising Alliance (“DAA”) Opt-Out Page (https://optout.aboutads.info). The DAA Opt-Out Page provides a tool that identifies its member companies that have cookies on your browser and provides links to those companies. 
    • Update the privacy settings in the help section of your browser, or in the settings tab on your mobile device. 
    • You may also click on the “Ad-Choices” icon in certain advertisements.
    • You may opt-out of third-party advertising networks by going to the Network Advertising Initiative’s Website (https://optout.net.workadvertising.org) and following the directions provided.
    • Additionally, many network advertising programs allow you to view and manage the interest categories they have compiled from your online browsing activities. These interest categories help determine the types of personalized ads you may receive. 

8.    California Privacy Rights

Under the California Consumer Privacy Act of 2018 (“CCPA”), California residents have the right to request:

  • The deletion of the personal information we have about them.
  • To know additional information about whether and how we collected, used and disclosed personal information about them; and
  • To know specific pieces of personal information we have about them. 

California residents also have the right not to receive discriminatory treatment if they exercise the rights listed above. 

Requests for Deletion and to Know About Information Collected. 

If you make a request for deletion of personal information or a request to know about personal information we have collected, we may require that you provide information and follow procedures so that we can verify the request and your jurisdiction before responding to it. The verification steps we take may differ depending on the request you make. We will match the information that you provide in your request to information we already have on file to verify your identity. If we are able to verify your request, we will process it. If we cannot verify your request, we may ask you for additional information to help us verify your request. 

California residents will be required to submit their first and last name and the email address associated with their account so that we can verify the request. Please provide as much of the requested information as possible to help us verify the request. We will only use the information received in a request for the purposes of responding to the request. 

California law permits California residents to use an authorized agent to make privacy rights request. We require that the authorized agent provide proof of the California resident’s written permission (for example, a power of attorney) that shows the authorized agent has the authority to submit a request for the California resident. An authorized agent must follow the process described. Below to make a request. We will additionally require the authorized agent to verify his/her own identity.

Other California Requirements.

If you are a California resident under the age of 18, and a registered user of any site where this Privacy Policy is posted, you may request and obtain removal of content or information you have publicly posted to the Podmob Services by contacting us at sup@podmob.com.

9.    Nevada Privacy Rights

If you are Nevada resident, you have the right to opt-out of the sale of certain personal information to third parties who intend to license or sell that personal information. You can exercise this right by contacting us at sup@podmob.com with the subject line “Nevada Do Not Sell Request” and providing us with your first and last name and the email address associated with your account. Please note that we do not currently sell your personal information as sales are defined in Nevada Revised Statutes Chapter 603A.

10.      Information Processing and Transfer

Podmob is a United States company, and the Podmob Services are provided from the United States. If you reside outside of the United States and choose to use our Services from tEurope or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please be aware that you are transferring your personal information outside of those regions to the United States for processing and storage.  Also, we may transfer your data from the United States to other countries or regions in connection with the storage and processing of data, fulfilling your requests, and operating the Services. By using the Podmob Services, or providing us with any information, including personal information, you consent to the collection, processing, maintenance, storage, and transfer of such information in and to the United States and other applicable countries in which the privacy laws may not be as comprehensive as, or equivalent to, those in the country where you reside and/or are a citizen. 

11.      How We Protect and Retain your Information

We maintain safeguards to help protect against loss, misuse or unauthorized access, disclosure, alteration, or destruction of the personal information you provide via the Podmob Services. However, as no electronic transmission or storage of data can be completely secure, we make no guarantees as to the security or privacy of your information. Therefore, any transmission of personal information to us is made at your own risk. 

We retain your account information and the information provided by you in the form of Posts indefinitely until such time that we determine it has no further commercial significance, at which time we may delete and/or aggregate and store it indefinitely. We may also retain and use this information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. 

12.      Third Party Links

The Podmob Services may from time to time contain links to third party websites and services for your convenience and information. If you access other sites using the links provided, you may leave the Podmob Services. When you access these other sites, please understand that the operators of these websites may collect information from you which will be used by them in accordance with their privacy policies and terms of use, which may differ from ours. We do not endorse or control the policies or practices of third-party websites that we do not control or operate. 

You should always read the privacy policy of any site you access in order to understand their specific privacy and information usage practices. 

13.      Children’s Personal Information

The services are not directed to children under the age of 13 (or other age as required by local law). Except where otherwise indicated, we do not knowingly collect or store any personal information from children under the age of 13. If a parent or guardian becomes aware that his or her child under the age of 13 has provided us with information without his or her content, he or she should contact us at sup@podmob.com. As required by applicable law, we will delete such information from our files within a reasonable time, unless we have a legal obligation to keep it. 

14.      Updates to this Privacy Policy

From time to time we may revise this Privacy Policy to reflect changes in the law or technology, or changes in our practices regarding information collection and use. If we make material revisions to the way we collect or use your personal information so that we are using it for purposes or sharing data with third parties that you have not consented to, we will notify you of those changes by annoyance the change through the Podmob Services, by email, or other communication. You should check our online services frequently for updates. 

Any changes to this Privacy Policy will become effective as of the Effective Date on the top of this page. By continuing to use the Podmob Services after the most current Effective Date, you will be deemed to have understood and agreed to such changes. If you do not agree with the terms of this Privacy Policy, as it may be amended from time to time, in whole or in part, please do not continue to use the Podmob Services. 

15.      Additional Terms

This Privacy Policy may be supplemented from time to time by additional terms, privacy statements, or notices that explain how we collect, use and share information in specific circumstances (“Additional Terms”). For example, Additional terms may contain details about how we collect personal information in specific contexts.
